These Terms and Conditions govern the relationship between JSC VIENUOLIKA (we) and our online shop customers (you). By using or accessing or visiting our online shop at www.sculp.lt you agree and/or affirm to be bound by these Terms and Conditions.
ACCURACY AND VARIATIONS
We reserve the right at any time without notice to revise the content of our online shop (including the products offered by us) and these Terms and Conditions. Any changes to these Terms and Conditions will be posted on our online shop and by continuing to use it following any such change you will signify that you agree to be bound by the revised Terms and Conditions of use.
All SCULP pieces are unique and are hand-made using highest-quality materials in our studio in Lithuania. Due to individual production every SCULP piece might slightly differ from the one shown in picture. Jewellery colors in picture may slightly differ from actually received piece due to your screen settings and the lighting when the photo shoot took place.
We try to describe the items of jewellery as accurately as possible, including images and measurements. If you would like more details about an item then please contact us prior ordering and we will be glad to help.
The product price is the price displayed for the product at the online shop at the time of ordering. Prices are liable to change at any time and without notice, but changes will not affect orders in respect of which we have already sent you our confirmation.
All prices stated on sculp.lt online shop are in EURO (VAT incl.). Shipping costs are not included.

TAXES AND DUTIES
For delivery to countries, that are part of the European Union, prices already include VAT (21%). All countries within the European Union are shipped to on a DDP (Delivery Duty Paid) basis, where taxes and duties are included in the price.
Deliveries to countries outside the European Union may be subject to import duties and/or taxes that are set once the package reaches the country. In this case an order is shipped on a DDU (Delivery Duty Unpaid) basis, which means that the price is exclusive of all taxes and duties. Charges for each order may differ as those are imposed directly by countries’ local customs.
Your order is accepted only after full payment is received and cleared. Once your payment has been received, we will confirm that your order has been accepted by sending our first confirmation email to you to the email address provided in your order form. Following this, we still reserve the right not to accept your order at any time at our discretion. If your order is rejected or your item is unavailable, we will contact you as soon as possible and you will be offered a full refund.
Our acceptance of your order brings into existence a legally binding contract between you and us on these Terms and Conditions.
Once your purchase is shipped, we will send you a second email with our final confirmation and expected delivery date.
We offer our customers a secure and convenient method for making payments online using PayPal or other payment options available on Paysera payment system. You can check the available payment types offered by Paysera for your country here. Both payment systems use industry-leading security measures to ensure that your financial information is kept private.
When you go to the checkout page you will have a possibility to select your preferred payment method. You will complete your payment details on the PayPal or Paysera websites. Once PayPal or Paysera clear your payment, we will send you our first email confirming your purchase.
If non of the above options is suitable for you – direct bank transfer is also available, but it will add a delay for your orders due to the need of payment to be cleared first.
PROCESSING AND DELIVERY
Our products are produced only in very limited quantities in our artisan studios in Lithuania. Therefore, it is possible that the piece that you wish to buy is not in stock, even though the words ADD TO CART are displayed on the website (you should see note “Available on backorder” above the button). Ordering on back-order will require up to 10 business days to process your order as it is the time required to individually produce one piece.
Please note that the order processing and delivery times are subject to payment clearance, stock availability and order destination. Order dispatch and shipping times may vary from 3 working days to 3 weeks, subject to the above mentioned circumstances. We aim to deliver your chosen items to the place and person of your choice, in the shortest possible time, and in case your ordered item is in stock and there are no other delay-causing conditions, we will dispatch it within a period of 3 working days.
We will contact you as soon as possible if there is a delay or items are out of stock.
The order processing and dispatch time may sometimes extend up to 4 weeks, in case the ordered item is not in stock and needs to be newly handcrafted for you.
After dispatching the order we will send a confirmation e-mail including a tracking code to you to follow the delivery progress. We will deliver the products to the address provided in the purchase order. The products are at your risk from the time your delivery is signed for. International orders may be subject to the payment of import duties and taxes. You are responsible for payment of any such import duties and taxes.
For all Lithuanian, Latvian and Estonian orders, we use Omniva courier service or post courier. For all international orders, we use national post courier or DHL Express, or DPD.
Delivery cost in Lithuania is 3 EURO flat-rate and 10 EURO flat-rate for the rest of the World.
Provided that the product delivery will delay significantly, our customer service will contact you via the email provided in the purchase order.
We reserve the right to deliver different products ordered in the same time separately.
In case the product has not arrived and you have not been contacted by our customer service, you are recommended to contact us.
We reserve the right to reject any order. In such cases the payments will be returned to your account within 30 days.
CANCELATIONS, RETURNS AND REFUNDS
You have the right to cancel the order before the product is dispatched. If you wish to cancel your order, you must contact us by sending us an email on firstname.lastname@example.org providing your name, address and order number in your message. We will return the payments made to your account not later than within 30 days.
According to Lithuanian Law No. 217 jewelry is not a subject to return or exchange if you did not like the shape, color, size etc.
You have the right to return or exchange a product within fourteen (14) days from the day when you received the product. You have the right to return a product if:
(1) the order has been cancelled according to these Terms and Conditions by notifying our customer service via email within fourteen (14) days of the product delivery, or the product has been shipped to us at the address Stikliu str. 6, Vilnius 01131, Lithuania within said fourteen (14) days for returning purposes;
(2) the product has not been used other than for the purpose of trying on for fit. If there is evidence to suggest that the products have been used to a degree such as to decrease the value of the product, you will lose your right to exercise a return;
(3) the product is in identical condition that you received it and all the parts of the product as well as the original invoice are included in the package; and
(4) the product has been repackaged into its original package.
In the return parcel you must enclose:
– the product in perfect saleable condition and in its original packaging;
– an original invoice;
– a filled-in Return Request Form.
Any returns that are damaged, soiled or returned without their original labels may not be accepted.
When returning the products you will be responsible for risk of damages during the return delivery. We can only refund goods that are returned in the condition they were sent, and not for any lost or stolen items.
The reimbursement will take place to your account as soon as we have received and inspected the returned products, however no later than within thirty (30) days from the day when we have received the returned products. You will receive an email confirmation to indicate that the refund has gone through.
We will refund you on the original price of the item returned under all requirements and in a perfect condition, but not including the shipping costs. In case you wish to exchange the returned product into another one, we will ship a new item of your choice to you at our own expense.
We will cover shipping costs incurred in returning the products if the return is a result of our error, i.e. the products are faulty or they where damaged during the shipment. If the product is faulty or damaged during the shipment, you must contact us via email email@example.com and inform about the said defect as soon as you noticed the defect but not later than within a maximum of 12 hours of receiving the order. We will not reimburse you with the costs before we have confirmed the defect in the product.
Items bought on SALE are not returnable for exchange or refund. All sales are final.
No refund may be made if you have not exercised your right of return under the terms of this Section. Our return policy does not affect your statutory rights.

10. WARRANTIES AND LIABILITY
Items are treated as faulty if a manufacturing fault occurs within 6 months of purchase.
Our warranty provided herein does not include normal tear and wear due to use of the product. Furthermore, our warranty does not include defects due to negligence in products care.
Treat your jewellery with care. You better not:
– hit or drop it onto a hard surface;
– pull, stretch, bend, kink or distort the chain in any other way;
– detach the chain from the pendant without a professional assistance;
– keep the piece in humidity or with other jewellery;
– rub or scratch the ceramic pendant.

After the purchase we are still the owner of all intellectual property rights, particularly design rights and copyrights, concerning our products.
You are not entitled to extract and/or re-utilise parts of the contents of the website. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (either once or many times) for re-utilisation of any substantial parts of this website.
You must not use our website and online shop in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired.
13. DATA PROTECTION
We will only use the customer’s data for purposes which the data are provided for and/or for correspondence with the customer.
14. GOVERNING LAW
The contract between us resulting out of these Terms and Conditions shall be governed by and interpreted in accordance with Lithuanian Law, and the Lithuanian Courts shall have exclusive jurisdiction to resolve any disputes between us.
